Генезис законодательства в области образования в странах постсоветского пространства

В статье рассмотрены вопросы становления законодательной базы в сфере образования республик бывшего Советского Союза. Дан правовой анализ межгосударственных соглашений стран — членов СНГ в области образования и соответствующих законодательных актов тех стран, в которых единожды принятый нормативно-правовой акт (Закон об образовании) изменялся на протяжении двух десятилетий в духе протекающих изменений (Украина, Молдова, Азербайджан).

Ключевые слова: Содружество Независимых Государств, образовательная сфера, системы образования, системы законодательства, образовательное законодательство, законодательно закрепленные принципы образования.

Genesis of Educational Legislation in the Countries of Former Soviet Union

The study of legal framework and legal practices in the field of education in former Soviet republics helps to predict scenarios of social development of the state, to identify future geopolitical risks and ways of entry into world educational space. This is especially important for the development and implementation of social policies at border territories of all CIS countries under conditions of interregional cultural cooperation and intensive migration.

The subject of my research is becoming of legal framework in the field of education in republics of former Soviet Union. As a basic research method I use legal analysis. I have been using it to study international agreements of CIS countries in the education and appropriate legislation of the countries in which once adopted legal act (Law on Education) was exposed to changes over the past two decades in the spirit of the changes taking place (Ukraine, Moldova, Azerbaijan). In my article, I show that the legislation of CIS countries in education has been and remains predominantly declarative. Moreover, the Education Acts, adopted in 1990s, on the one hand, are generally more democratic than the laws of the 2000s. On the other hand, it was in the 1990s, when lawmakers laid in educational legislation enormous potential of ethno-political and geopolitical conflictness, which is realized in our days.

At the same time, my conclusions are:

(i) by now in almost every CIS country, formation of legal framework of education assumes accounting both general trends in global educational space development and national traditions of education;

(ii) the majority of states overcame the ‘childhood diseases’ of disintegration and formed  regulatory provisions of their educational legislation from the positions of their active participation in the global educational space;

(iii) active legislative process in education has led to the fact that in a number of CIS countries during the last years have been adopted organic laws in the field of education. These laws have been significantly expanded and acquire the status of national educational codes. Commonwealth states actively use the international educational legislation. Their active participation in creating and amending the model educational legislation of the CIS countries is a testament to the interest in the development of the legal framework of a CIS common educational space.
